Guided tour waiver of liability, assumption of risk & media release

Activities: Guided kayaking / fishing / camping tours
Location: Trinidad and Tobago

1. Tour participation acknowledgment

I understand that I am participating in a guided outdoor tour organized by Adventurer's Instincts, which may include kayaking, fishing, camping, transportation, and related outdoor activities in remote or coastal environments.

I acknowledge that such tours may involve limited access to immediate medical assistance and changing environmental conditions.

2. Risks

I acknowledge that participation involves inherent risks, including but not limited to:

Capsizing, drowning, or water-related incidents
Strong currents, tides, and rough water
Sudden weather changes (including squalls and storms)
Heat exhaustion, dehydration, sunburn
Slips, falls, or injuries on uneven terrain
Mangrove entanglements and wildlife encounters
Equipment malfunction or failure
Risks associated with camping and outdoor living

I voluntarily assume full responsibility for all risks, whether known or unknown, and whether caused by negligence or otherwise.

3. Release of liability

In consideration of being allowed to participate, I hereby release, waive, and discharge Adventurer's Instincts, its owners, guides, employees, contractors, and agents from any and all liability for injury, illness, death, or property damage arising out of or related to my participation, including claims arising from ordinary negligence.

4. Indemnification

I agree to indemnify and hold harmless Adventurer's Instincts from any claims, damages, losses, or expenses (including legal fees) arising from my participation or any claims brought on my behalf.

5. Health & fitness declaration

I certify that I am physically fit to participate in this tour and have no medical conditions that would make participation unsafe.

I agree to disclose any relevant medical conditions, allergies, or medications prior to the tour.

6. Safety rules & guide authority

I agree to follow all instructions given by guides or staff at all times.

I understand that guides have full authority to:

Modify or cancel activities due to weather or safety concerns
Refuse or remove participants who behave unsafely or fail to follow instructions

No refund may be issued if removal is due to non-compliance.

7. Personal responsibility

I accept full responsibility for:

My personal belongings and valuables
My actions and decisions during the tour
Any damage caused to equipment through misuse or negligence

8. Alcohol & drug policy

I confirm that I will not participate under the influence of drugs or excessive alcohol and will not consume substances in a way that compromises safety.

9. Emergency medical consent

In the event of injury or illness, I authorize Adventurer's Instincts to obtain emergency medical treatment on my behalf if I am unable to do so. I agree to be responsible for any medical or evacuation costs incurred.

10. Photo & video use (optional)

Permission for promotional photos and video is optional. When you join a tour in person, you can choose whether to allow use of your image or likeness for marketing.

If you consent

You may grant permission for Adventurer's Instincts to photograph, film, or record you during the tour and to use those images and recordings for promotional, advertising, and marketing purposes (including social media, websites, and printed materials) without compensation, and waive rights to review or approve such materials.

If you do not consent

You may decline promotional use of your name, image, likeness, or voice. You may still appear incidentally in group or setting shots where individual marketing use is not practicable, and operational or safety documentation may still occur.

11. Itinerary changes & force majeure

I understand that itineraries may change due to weather, safety conditions, or unforeseen circumstances beyond the provider's control. Adventurer's Instincts shall not be liable for cancellations, delays, or changes caused by events such as severe weather, natural disasters, or other force majeure events.

12. Governing law

This agreement shall be governed by the laws of the Republic of Trinidad and Tobago, and any disputes shall be resolved exclusively in its courts.

13. Acknowledgment of understanding

I confirm that I have read and fully understand this agreement and that I am signing it voluntarily. I understand that I am waiving certain legal rights.

14. No insurance coverage

I acknowledge and understand that Adventurer's Instincts does not provide any medical, health, accident, or personal property insurance coverage for participants.

I confirm that I am solely responsible for obtaining and maintaining any personal insurance coverage I consider necessary, including medical, travel, or evacuation insurance.

I further acknowledge that I am financially responsible for any and all medical expenses, emergency evacuation costs, or other losses or damages that may be incurred as a result of my participation in the tour.
